基本权利主体在某一特定法律行为中放弃受宪法保护的法律地位。

公民的基本权利
宪法意义上的取得赔偿权，特指取得国家赔偿的权利，即公民、法人或者其他组织的合法权益因国家机关或其工作人员违法行使职权而受到损失的，依照法律规定有要求国家给予赔偿的权利。
