当事人实施的能够产生特定民事诉讼法律效果，且其要件和效果均由民事诉讼法规范规定的行为。

当事人能力
能够成为一般民事诉讼当事人所必须具备的诉讼法上的能力或资格。又称当事人诉讼权利能力、诉讼法上的权利能力。
诉讼行为能力/ capacity to action /capacity to action
诉讼行为能力
当事人可以亲自实施诉讼行为，并通过自己的行为行使诉讼权利和承担诉讼义务的诉讼法上的资格。

当事人变更
在诉讼过程中，根据法律的规定或基于当事人的意思，原诉讼的当事人被变更为新的当事人的一种诉讼现象。

任意的当事人变更
在诉讼中因原诉讼当事人不适格而发生的当事人更换。即在诉讼中，当起诉或者应诉的当事人不符合正当当事人的条件时，法院依一定的程序使正当当事人取代非正当当事人参加诉讼。
